carbonpaid terms and conditionsThis website (the "Website"), which is located at www.carbonpaid.com, is owned and operated by Carbonpaid Limited ("Carbonpaid", "we", "us" and "our"). These terms and conditions of use ("User Agreement") govern the terms and conditions on which you (the "User") may access and use the Website and its content. This User Agreement is effective as of 1 December 2006.
By using the Website, you acknowledge that you have read this User Agreement, understand it and agree to be bound by its terms and conditions. You also acknowledge that you have read and understand the Privacy Policy. If you do not agree to this User Agreement or the Privacy Policy, you should not use or access the Website.
- Eligibility to use the Website. You must be 16 years or older to purchase carbon credits using the Website. If you under 16 years old, you may only use the Website to purchase offset credits with the consent of a parent or guardian.
- Privacy Policy. Carbonpaid takes your privacy very seriously and collection and use of personal information is governed by our Privacy Policy. Please read our Privacy Policy carefully here.
- Your Conduct. You shall not use the Website in any way that causes, or is likely to cause, the Website or access to it to be interrupted, damaged or impaired in any way.
- Website Content. Carbonpaid owns and retains all rights, including all copyright and other intellectual property rights, in all content included on the Website. You are responsible for complying with all applicable copyright and other laws in respect of the Website and its content.
- Changes to this User Agreement. Carbonpaid reserves the right, in its sole discretion, to change, modify, add or delete any part of this User Agreement at any time without further notice. If we do make any such changes, we will post the changes to this User Agreement on this webpage and will indicate at the top of the page the effective date of the version you are viewing. Your continued use of the Website after any such changes constitutes your acceptance to the amended User Agreement. You are responsible for regularly reviewing this User Agreement so that you will be aware of any changes.
- Internet and Website Access. We try our best to ensure that availability to the Website is uninterrupted and that the Website is error-free. However due to the nature of the Internet, this cannot be guaranteed. Your access to the Website may also be occasionally suspended or restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.
- Links. Carbonpaid is not responsible for the content of any third party websites, whether or not such website is accessed from a hyperlink contained on the Website.
- Information. The information we provide on the Website is intended for personal use only and you shall not retransmit or republish any of it in any form. We may use third party information or provide hyperlinks to third party websites on the Website. Where we do this, we trust that such information is accurate and reliable and we aim to ensure that all information published on the Website is accurate and reliable, however, we give no warranties or guarantees as to the accuracy or reliability of information published on the Website.
- Your Purchase of Offset Credits. If you purchase offset credits with Carbonpaid using the Website, the payments you make will be combined with payments received from other Users (together, the "Funds") and held in an interest bearing bank account. We will, with the assistance of advice from expert traders, use the Funds to invest in selected carbon credits. Such investment will be in the form of a donation. You acknowledge that the price of carbon credits, like other commodities, is subject to fluctuations.
We use all reasonable efforts to ensure that (a) we use your payment within a reasonable time of receiving it, subject to allowing for it to be aggregated with the Funds and that, in the meantime, the account in which we hold the Funds benefits from a competitive interest rate, (b) we use the Funds to buy into the best value carbon credit projects on the market at the relevant time, (c) we minimise the administration costs involved in operating Carbonpaid to provide the greatest possible environmental benefits from our service and use a maximum of 20% of the Funds for Carbonpaid's administrative and operational requirements, and (d) you receive your Carbonpaid welcome pack by normal UK second class post within a reasonable time of the date on which you register. Although it is our intention to achieve the above aims and we use all reasonable efforts acting in good faith in order to do so, there may be instances where this is beyond our control and we give no warranties or guarantees that we will achieve the above aims.
- Exclusion of Warranties. Carbonpaid gives no warranties whatsoever in relation to the Website or the use of Funds. Carbonpaid excludes to the fullest extent permitted by law all express, implied and statutory warranties. Carbonpaid expressly disclaims that: (a) the Website or the server that makes it available will be uninterrupted, error-free, timely, secure or otherwise reliable, (b) defects or errors on the Website will be corrected, or (c) the content of the Website or information published on it is lawful, correct or accurate.
- Limitations of Liability. Carbonpaid excludes liability and responsibility for any loss that might result to you or a third party arising from or in connection with: (a) your use or inability to use the Website or any part of it; or (b) the nature, accuracy, reliability or truth of information published on the Website.
Carbonpaid excludes all liability for any indirect, incidental, consequential, special, exemplary or punitive damages or losses (including without limitation loss of profit, loss of data, expected benefit, goodwill or other intangible losses, and liability to third parties) whether based in contract, tort or otherwise arising out of or in connection with your use of the Website, or any suspension or termination of the Website.
- Entire Agreement / Waiver. This User Agreement represents the entire agreement between you and Carbonpaid in relation to your use of the Website (including its content), and it supersedes all prior or contemporaneous communications (whether in writing, oral or electronic) between you and Carbonpaid with respect to the Website. Any waiver of any term of this User Agreement will only be effective if in writing and signed by a party and no waiver by Carbonpaid of any right or remedy under this User Agreement will prevent Carbonpaid from enforcing any of its rights or remedies in any other situation where you breach this User Agreement.
- Nature of relationship / Severability. No joint venture, partnership, employment, or agency relationship exists between you and Carbonpaid as a result of this User Agreement or your utilisation of the Website. If any provision of this User Agreement is held invalid, unlawful or unenforceable by a court or tribunal of competent jurisdiction, the remaining provisions of this User Agreement shall continue in full force and effect.
- Governing Law. This User Agreement shall be governed and construed in accordance with English law. The English courts shall have exclusive jurisdiction over any dispute arising out of your use of the Website.

Upon request via postal mail or e-mail, Carbonpaid will provide to you a summary of any Personal Data retained by Carbonpaid regarding you.
